Following our earlier newsflash on Jersey’s Madrid System fees, we outline the broader changes that took effect on 01 August 2026.
The Trade Marks (Jersey) Law 2026 allows applicants to seek registration directly in Jersey without first obtaining a corresponding UK registration. The framework provides for examination, publication for opposition, revocation and invalidity proceedings. Applications can cover multiple classes of goods and services under the Nice Classification.
The new intellectual property register is administered by the Jersey Financial Services Commission, following the transfer of responsibility from the Judicial Greffe.
Separate Designation under the Madrid System
Jersey is now a separate designation under the Madrid System. For new international applications and subsequent designations from 01 August 2026, designating the United Kingdom alone does not secure protection in Jersey. Applicants seeking protection there must designate Jersey separately.
Jersey-specific individual fees apply to applications, subsequent designations and renewals.
Existing Rights and Renewals
Existing Jersey registrations are carried into the new register under the transitional provisions, with renewal requirements continuing to apply.
For international registrations with a UK designation recorded before 1 August 2026 and protected in the UK on that date, WIPO automatically records a Jersey designation without action by the holder. Where the UK refusal period remains open, this follows the relevant grant of protection. The Jersey and UK designations then operate independently, and Jersey must be included separately in renewal instructions where continued protection is required.
Brand owners should therefore review the basis of their existing Jersey protection, check the relevant register entries and update filing and renewal instructions. Whether a new filing is needed depends on the rights already held and the applicable transitional provisions.
